TERMS OF USE

These Terms of Use take effect as of 01/12/2024 and were last updated on 01/12/2024.

PT Skortech Karya Indonesia (hereinafter referred to as "SkorLife," "Company," "We") is a company that provides users ("Users," "You," "I") with easy access to obtain Credit Information and any other relevant data, giving You the opportunity to manage Your Credit Information or build Your credit history through the SkorLife Platform.

These Terms of Use are incorporated into and must be read together with Our Privacy Policy. You understand and agree that these Terms of Use are inseparable from the Privacy Policy.

These Terms of Use are established to regulate the provision of Services as defined below, as follows:

1. Definitions

Licensed Credit Bureau means an institution that collects and processes credit or financing data and other data to generate credit information that has the necessary business license from the Financial Services Authority of the Republic of Indonesia as a Credit Information Management Institution, as described in Financial Services Authority Regulation No. 5/POJK.03/2022 or as amended from time to time.

User Account Data means the data in Your account on Your financial service provider’s network, including but not limited to bank transactions, credit cards, debit cards, and deposits.

Credit Information means products and/or services generated by the Licensed Credit Bureau in written, verbal, or other forms, sourced from credit or financing data and other data collected and processed by the Licensed Credit Bureau.

Losses means any losses, claims, damages, errors, malpractice, negligence, liabilities, responsibilities, fines, judgments, arbitration decisions, lawsuits, legal proceedings, investigations, and inquiries.

Credit Report is a report on Credit Data that has been organized, analyzed, and structured by SkorLife or in collaboration with third parties to be more easily understood by Users, made available on the SkorLife Platform or sent directly to the User’s email.

Email Service is a personal electronic mail service managed and controlled by the User to receive information, including but not limited to their Credit Information.

Services means the services provided by Us to You through the SkorLife Platform as outlined in Clause 2(a).

Payment Service Provider means a third-party payment service provider working with Us to process, transmit, and facilitate payment methods on the SkorLife Platform.

SkorLife Platform means applications, digital platforms, websites, social media, partner platforms, or any platform in any form managed and operated by Us.

Dispute means disputes, conflicts, controversies, or disagreements.

2. Services

Service Provision
We act on behalf of and for the benefit of Users in accordance with the authorization and power granted to Us under Clause 3 of these Terms of Use. The Services provided on the SkorLife Platform include:
- 1. Facilitating Credit Information Provision
  We provide You with a secure environment and infrastructure to request Your Credit Information digitally from the Licensed Credit Bureau. This includes filling out Your Credit Information request form, performing digital e-KYC as specified in Clause 2(b)(2), and submitting the request form to the Licensed Credit Bureau. If e-KYC is successful, the Licensed Credit Bureau will send Your Credit Information directly to Your Email Service. Your access to Your Credit Information is within Your control and does not require You to use the SkorLife Platform to receive this information.
- 2. Facilitating Credit Information Monitoring
  To help You monitor Your Credit Information, We request Your permission to access Your Credit Information through Your Email Service to generate a Credit Report. Using Our expertise, We analyze and provide insights and recommendations to explain Your Credit Information, factors affecting it, and Your financial health in the form of a Credit Report. We also offer tips to help You manage Your Credit Information, including setting reminders to manage Your obligations on time, credit monitoring, and identity monitoring.
- 3. Facilitating Communication for Credit Data Inaccuracy Adjustments
  We provide communication services between You and the Licensed Credit Bureau to correct Your Credit Data if inaccuracies occur between the Credit Information provided by the Licensed Credit Bureau and Your actual condition.
- 4. Requesting Limited Access to Your Email Service to Read Your Credit Bills
  We offer services to help You manage Your credit card bills more efficiently. This service includes scanning Your email, analyzing it using Optical Character Recognition (OCR) technology to detect relevant credit bill information, identifying unpaid credit card bills, and providing notifications or reports to You. Additionally, We facilitate direct bill payments through the SkorLife Platform, making it easier and more practical for You to settle bills.
- 5. Facilitating Third-Party Companies Working with SkorLife to Access Your Credit Information
  In certain circumstances, We facilitate third-party companies working with SkorLife to access Your Credit Information. This access will be subject to Your explicit consent.

3. Authorization and Power Given in Relation to Service Provision

You hereby agree and grant Us full authority and power to act on Your behalf to:

1. Collect and process all necessary personal data and complete all required forms to request Your Credit Information;
2. Obtain and/or receive personal and financial data and/or other related information You have with the Licensed Credit Bureau in the form of Credit Information through Your Email Service;
3. Obtain, collect, process, analyze, store, display, and/or send Your data and information periodically from and/or to relevant parties concerning the provision of Services to You through the SkorLife Platform;
4. In relation to Credit Information corrections, You also grant Us authority to forward all necessary personal and financial data to request Credit Information corrections from the Licensed Credit Bureau.

4. Termination / Account Deletion

You may terminate Your legal agreement with Us at any time by deleting Your account and ceasing to use the SkorLife Platform Services. We provide all Users with the option to delete their accounts via the SkorLife Platform.

Following a deletion request or account termination by Us, We consider the agreement terminated. Account deletion or termination does not end Your obligations that existed before deletion or termination.

5. Limitations & Liability

The limitations and liabilities applicable to the provision of Services are as follows:

The provision of Services is not intended to create and does not constitute a consultant relationship or any similar relationship between the User and any person or entity affiliated with SkorLife. The Services should not be used as a substitute for competent legal, financial, or other professional advice. To the extent permitted by law, the User hereby agrees to fully release and discharge SkorLife, including but not limited to its shareholders, directors, commissioners, employees, and/or consultants, from any and all Losses related to the provision of the Services.

To the extent permitted by law, SkorLife shall not be liable, directly or indirectly, for the accuracy of the Credit Information provided by the Licensed Credit Bureau. Therefore, you agree to fully release and discharge SkorLife from any Losses related to inaccurate information.

You agree to immediately notify Us if you become aware of any loss, theft, or unauthorized use of the Licensee’s Access Information. We reserve the right to deny access to the Services (or any part thereof) if We reasonably believe that you have experienced loss, theft, or unauthorized use of the Licensee’s Access Information, to enable Us to rectify the issue. You hereby release Us from any Losses related to such occurrences.

You acknowledge and agree that We and third-party vendors (including but not limited to the Licensed Credit Bureau) have permission to aggregate User Account Data with data from others for data analytics purposes, including obtaining insights at an aggregated level, such as analyzing the average age and gender of SkorLife Users. This also includes conducting specific analytical research, performance tracking, and comparisons, and carrying out other activities aimed at improving the Services and providing troubleshooting and technical support, to the extent permitted by applicable regulations. However, User Account Data will not be directly identifiable to you or any individual.

Credit Information may differ from the credit assessment/reports provided by domestic or foreign credit bureaus or other financial institutions. If you use the Credit Information to obtain or apply for any financial products or facilities, We do not guarantee that your application will be successful.

6. Subscription and Service Fee

If you are a new User making a request for your Credit Information for the first time, you may obtain your Credit Information free of charge by using a voucher provided by Us and/or through other applicable methods. For any subsequent requests for Credit Information, you will be charged a fee, which must be paid in advance before you can receive the Credit Information.

However, We reserve the right to change the Service fee policy at any time, including but not limited to discontinuing voucher promotions or ceasing to offer free Services upon the first-time use by a User.

7. Collaboration with Payment Service Providers

We may collaborate with Payment Service Providers to facilitate payments made on the SkorLife Platform. By submitting your payment information on the SkorLife Platform, you authorize Us to provide such information to the Payment Service Provider to facilitate the payment process.

You acknowledge and understand that you may be subject to additional terms and conditions imposed by the relevant Payment Service Provider, and We recommend that you review the terms and conditions of the respective Payment Service Provider.

You also acknowledge and understand that Payment Service Providers may experience failures, issues, or unexpected technical disruptions while transmitting, processing, or forwarding your payments to your bank account or e-wallet. In such cases, you agree and commit not to make any claims or demands against Us for any and all damages or losses (including but not limited to financial loss, reputation damage, loss of profits, or other intangible losses) that may arise, either directly or indirectly, due to failures, issues, or technical disruptions caused by the Payment Service Provider.

8. Prohibitions

You agree not to use or attempt to use the SkorLife Platform for any illegal or prohibited purposes as stated in these Terms of Use or any applicable laws and regulations, including but not limited to:

Creating and/or using hardware, software, features, and/or any other devices with the intention of manipulating the SkorLife Platform system, making copies of the SkorLife Platform or parts of it, including manipulations related to: (i) Content, (ii) Crawling/scraping activities, (iii) Other activities that can reasonably be considered as manipulative actions against the SkorLife Platform system.

Abusing or disrupting the operation of the SkorLife Platform or servers or networks connected to the SkorLife Platform, including installing, sending, transmitting, uploading, or making available any material containing software viruses, worms, codes, files, or programs designed to disrupt, destroy, or limit the functionality of any software, hardware, or telecommunications equipment.

Collecting or storing personal data about other SkorLife Platform Users in connection with prohibited behaviors and activities set forth in these Terms of Use.

Impersonating any person or entity, falsely stating, or misrepresenting your affiliation with any person or entity.

Removing copyright, trademarks, or other intellectual property ownership notices from the SkorLife Platform.

Gaining unauthorized access to any part or feature of the SkorLife Platform, including taking any actions that negatively impact or cause inconvenience to other Users.

9. Governing Law and Dispute Resolution

1. These Terms of Use and the provision of Services are governed by and interpreted in accordance with Indonesian law.

2. The parties agree that in the event of a Dispute arising from or related to these Terms of Use or their execution, the Parties shall endeavor to resolve the Dispute amicably within 30 (thirty) business days after written notification from one Party to the other regarding the existence of a Dispute.

3. If, within the period specified above, the parties cannot resolve the Dispute amicably, the Dispute shall be referred to and finally resolved by the South Jakarta District Court.

10. Language

These Terms of Use are made in Indonesian and English. If there is any inconsistency or difference in interpretation between the Indonesian and English versions, You agree that the Indonesian version shall prevail to the extent of the inconsistency or difference, and the relevant English version shall be automatically amended to conform to the relevant part of the Indonesian version.

11. Severability

If any provision of these Terms of Use or its application to any situation or circumstance becomes invalid or unenforceable, the remaining provisions of these Terms of Use shall not be affected, and each remaining provision shall continue to be valid and enforceable in full.

12. Entire Agreement

These Terms of Use constitute the entire agreement between you and SkorLife concerning the subject matter of these terms and conditions and supersede any previous versions of these Terms of Use.

You may be subject to additional terms and conditions when using, purchasing, or accessing other services, affiliated services, or third-party content or materials.

13. Changes to the Terms of Use and Privacy Policy

We reserve the right to change, modify, add, or amend our Terms of Use and Privacy Policy from time to time without prior notice to Users, and any changes will be displayed on this page. By continuing to use the SkorLife Platform after any changes, modifications, additions, and/or amendments to the Terms of Use and Privacy Policy, you agree to those changes, modifications, additions, and/or amendments. We encourage you to periodically review and check for any changes, modifications, additions, and/or amendments to our Terms of Use and Privacy Policy.

14. Notifications

We may send receipts, invoices, notifications, newsletters, promotions, alerts, and other information via your registered phone number and/or email address. You may opt out of receiving messages at any time by changing your preferences and settings in your account. You acknowledge that your decision to opt out of messages may affect your use of the SkorLife Platform. For certain messages related to our Services that we consider important, you may not have the option to opt out of receiving them.

In addition, any revocation of your authorization and power of attorney granted to us may be sent electronically to the email address: wecare@skorlife.com.

AUTHORIZATION AND CONSENT BY USER

I have read, understood, and agreed to the Terms of Use & Privacy Policy, where both documents form an inseparable unit. I also guarantee the accuracy of my personal data for further processing by VIDA as a partner of SkorLife.

I hereby agree to grant the authorization and power given under these Terms of Use and Privacy Policy to SkorLife. This consent is given by me voluntarily without coercion from any party.

The granting of authorization and power as stipulated in these Terms of Use and Privacy Policy shall remain in effect continuously until I revoke this authorization or until my account has been inactive for two (2) years, whichever occurs first. Thus, the authority for all requests for Credit Information and customer experiences from the Licensed Credit Bureau by SkorLife on my behalf will remain covered under this authorization as long as it is still in effect.

In the event of the expiration or revocation of this authorization, the authority and power stipulated in these Terms of Use will be reinstated after I provide my consent again on the SkorLife Platform. Once the renewed consent is given, the period of authorization and power under these Terms of Use shall be counted from the date the renewed consent is granted. This authorization and consent are governed by Indonesian law.

By checking the box after the statement “I understand and agree with the Terms of Use & Privacy Policy”, you hereby agree to be bound by these Terms of Use.
